1. About Arts.Sale

Arts.Sale is an online marketplace operated by 689 PTY LTD (ABN pending) that connects independent artists ("Vendors") with buyers ("Customers"). By using our platform, you agree to these terms.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years old to create an account or make purchases.

3. Vendor Terms

Vendors must apply and be approved by Arts.Sale before listing artwork. A non-refundable sign-up fee of $50 AUD is required. Vendors represent that all artwork listed is original work they have the right to sell. Arts.Sale reserves the right to remove listings or suspend vendor accounts at any time.

Platform commission is $5 AUD flat fee plus 1% of the sale price per transaction. Commission rates may be updated with 30 days notice.

4. Purchases & Payments

All prices are listed in Australian Dollars (AUD) unless otherwise stated. Payment is processed securely via Stripe. Buyer payment is held by the platform until delivery is confirmed or the auto-complete period expires (7 days after delivery).

5. Shipping & Delivery

Vendors are responsible for packaging and shipping artwork safely. Shipping costs are set by the vendor and clearly displayed before purchase. Delivery timeframes depend on the vendor's location and shipping method chosen.

6. Disputes & Returns

Buyers may open a dispute within 14 days of confirmed delivery if the artwork is significantly different from its listing description, arrives damaged, or does not arrive at all. Arts.Sale will mediate disputes between buyers and vendors. See our Refund Policy for details.

7. Commission Paintings

Commission paintings are custom orders between a buyer and vendor. Terms including price, timeline, and specifications are agreed between the parties. Arts.Sale facilitates communication and payment but is not responsible for the outcome of custom commissions.

8. Intellectual Property

Artists retain full copyright and intellectual property rights to their artwork. By listing on Arts.Sale, vendors grant the platform a non-exclusive license to display their artwork images for marketing and promotional purposes on the platform.

9. AI Assistant

Arts.Sale provides an AI-powered assistant ("Leonardo") to help vendors create listings. Content generated by the AI is a suggestion only. Vendors are responsible for reviewing and approving all listing content before publishing.

10. Prohibited Conduct

Users may not: list counterfeit, copied, or stolen artwork; manipulate reviews or ratings; circumvent the platform to avoid fees; use the platform for money laundering or fraud; harass other users.

11. Limitation of Liability

Arts.Sale acts as a marketplace facilitator. We are not a party to transactions between buyers and vendors. We do not guarantee the quality, safety, or legality of items listed. Our liability is limited to the platform fees collected on any disputed transaction.

12. Modifications

We may update these terms at any time. Continued use of the platform after changes constitutes acceptance. Significant changes will be communicated via email to registered users.

13. Governing Law

These terms are governed by the laws of Australia. Any disputes will be resolved in the courts of New South Wales, Australia.
